Please read these terms carefully before using SOOOTRA services.
1. Acceptance of Terms
By accessing or using the SOOOTRA website, mobile application, or any of our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. We reserve the right to update these terms at any time, and your continued use of our services constitutes acceptance of any changes.
2. Eligibility
To use SOOOTRA, you must be at least 18 years of age (or the age of majority in your jurisdiction), reside in the United States, and be able to form a legally binding contract. By creating an account, you represent that you meet these eligibility requirements. SOOOTRA services are not intended for use by minors without parental or guardian consent.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You must notify us immediately of any unauthorized use of your account.
4. Telehealth Services
SOOOTRA provides telehealth dermatology services through licensed healthcare providers. By using our services, you consent to receiving medical care through telehealth technology. Our providers will review your skin profile, medical history, and photos to create a personalized treatment plan. The provider-patient relationship is formed between you and your assigned provider, not with SOOOTRA as a company.
5. Subscriptions and Billing
SOOOTRA operates on a subscription model. By subscribing, you authorize us to charge your payment method on a recurring basis at the frequency you selected. You may cancel or modify your subscription at any time through your account settings. Cancellations take effect at the end of the current billing cycle. Prices are subject to change with reasonable notice.
6. Products and Shipping
SOOOTRA products are prescription skincare formulas and over-the-counter products. Prescription products are dispensed by our licensed pharmacy based on your provider's prescription. We make reasonable efforts to deliver products on time but are not responsible for shipping delays caused by carriers or circumstances beyond our control.
7. Intellectual Property
All content on the SOOOTRA platform, including text, graphics, logos, images, and software, is the property of SOOOTRA or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
8. Limitation of Liability
To the maximum extent permitted by law, SOOOTRA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claims related to our services shall not exceed the amount you paid to SOOOTRA in the 12 months preceding the claim. Some jurisdictions do not allow limitations on certain damages, so some of these limitations may not apply to you.
9. Dispute Resolution
Any disputes arising from these terms or your use of SOOOTRA services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. This arbitration agreement does not preclude you from filing complaints with regulatory agencies.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the courts of San Francisco County, California.
